Article L716-11 of the French Intellectual Property Code

The same penalties shall apply to anyone who:

a) knowingly makes any use whatsoever of a registered collective or guarantee mark under conditions other than those prescribed in the regulations accompanying the registration;

b) knowingly sells or offers for sale a product bearing a collective or guarantee mark that has been used improperly.

The provisions of this Article shall apply to the trade union marks provided for in Chapter IV of Title III of Book I of Part Two of the Labour Code.

Sera puni des mêmes peines quiconque :

a) Aura sciemment fait un usage quelconque d’une marque collective ou d’une marque de garantie enregistrée dans des conditions autres que celles prescrites au règlement accompagnant le dépôt ;

b) Aura sciemment vendu ou mis en vente un produit revêtu d’une marque collective ou d’une marque de garantie irrégulièrement employée.

Les dispositions du présent article sont applicables aux marques syndicales prévues par le chapitre IV du titre III du livre Ier de la deuxième partie du code du travail.
