Article L716-4-4 of the French Intellectual Property Code

An action brought in accordance with Regulation (EU) 608/2013 of 12 June 2013 by the trade mark proprietor on the basis of the provisions of Article L. 713-3-2 shall be inadmissible if, in the course of the proceedings to determine whether the registered trade mark has been infringed, the declarant or holder of the goods provides evidence that the registered trade mark proprietor does not have the right to prohibit the placing on the market of the goods in the country of final destination.

Est irrecevable toute action engagée conformément au règlement (UE) 608/2013 du 12 juin 2013 par le titulaire de la marque sur le fondement des dispositions de l’article L. 713-3-2 si, au cours de la procédure visant à déterminer s’il été porté atteinte à la marque enregistrée, le déclarant ou le détenteur des produits apporte la preuve que le titulaire de la marque enregistrée n’a pas le droit d’interdire la mise sur le marché des produits dans le pays de destination finale.
