I. – The Institut d’émission d’outre-mer carries out in the Wallis and Futuna Islands the tasks assigned to the Banque de France in mainland France relating to the treatment of overindebtedness of private individuals. An agreement signed between the State and the Institute sets out the terms and conditions for the performance of this task and the terms and conditions for its remuneration.
The Institut d’émission d’outre-mer may provide assistance to French Polynesia and New Caledonia for the processing of household overindebtedness. An agreement signed between the Institut and French Polynesia, on the one hand, and between the Institut and New Caledonia, on the other hand, shall define the conditions for the performance of this mission and the remuneration of the Institut.
II. – In New Caledonia, French Polynesia and the Wallis and Futuna Islands, the Institut d’émission d’outre-mer may exercise, in the name and on behalf of the Autorité des marchés financiers, the latter’s powers of control and investigation. An agreement signed between the Institut d’émission d’outre-mer and the Autorité des marchés financiers shall define the conditions under which these supervisory and investigative powers shall be exercised and the conditions under which the Institut d’émission d’outre-mer shall be remunerated.
The Institut d’émission d’outre-mer shall be exempt from professional secrecy in the performance of its duties.
III. – The Institut d’émission d’outre-mer may provide, in New Caledonia, French Polynesia and the Wallis and Futuna Islands, any research or services on behalf of third parties, with the agreement of its Supervisory Board. These services are subject to the signature of agreements that define the terms and conditions of the Institute’s remuneration.
