The administrative authority may authorise a foreign national who proves that it is impossible to leave French territory or that he/she is unable to return to his/her country of origin or to go to any other country, to remain temporarily in the territory by placing him/her under house arrest until there is a reasonable prospect of his/her obligation being fulfilled, in the following cases:
1° The foreign national is the subject of a decision imposing an obligation to leave French territory for which the period for voluntary departure has expired or has not been granted;
2° The foreign national must be removed to enforce a ban on returning to French territory pursuant to articles L. 612-6, L. 612-7 and L. 612-8;
3° The foreign national must be removed to implement a decision taken by another State, pursuant to Article L. 615-1;
4° The foreign national must be handed over to the authorities of another State pursuant to Article L. 621-1;
5° The foreign national must be removed to enforce a travel ban on French territory pursuant to Article L. 622-1;
6° The foreign national is the subject of a deportation order;
7° The foreign national must be deported in execution of a judicial deportation order issued in application of the second paragraph of article 131-30 of the penal code;
8° The foreign national must be deported in execution of an administrative deportation order.
The detailed rules for the application of this article are laid down by decree in the Conseil d’Etat.
