Article L742-1 of the French Consumer Code

If the examination of the request for treatment of the overindebtedness situation reveals that the debtor is in an irremediably compromised situation as defined in the second paragraph of article L. 724-1 and has assets other than those mentioned in 1° of the same article, the commission, after summoning the debtor and obtaining his agreement, refers the matter to the protection litigation judge for the purpose of opening a personal recovery procedure with judicial liquidation.

The debtor’s failure to respond to the summons shall constitute a refusal of such referral.

If the debtor refuses, the commission resumes its mission under the terms of the provisions of articles L. 732-1, L. 733-1, L. 733-4 and L. 733-7.

Article L742-1

Si l’examen de la demande de traitement de la situation de surendettement fait apparaître que le débiteur se trouve dans la situation irrémédiablement compromise définie au deuxième alinéa de l’article L. 724-1 et dispose de biens autres que ceux mentionnés au 1° du même article, la commission, après avoir convoqué le débiteur et obtenu son accord, saisit le juge des contentieux de la protection aux fins d’ouverture d’une procédure de rétablissement personnel avec liquidation judiciaire.

L’absence de réponse du débiteur aux convocations vaut refus de cette saisine.

En cas de refus du débiteur, la commission reprend sa mission dans les termes des dispositions des articles L. 732-1, L. 733-1, L. 733-4 et L. 733-7.
