Article L742-6 of the French Code governing the entry and residence of foreign nationals and the right of asylum

As an exception to article L. 742-4, the judge responsible for freedoms and detention may also be asked to extend the period of detention beyond thirty days if the foreign national has been sentenced to deportation for acts of terrorism covered by Title II of Book IV of the Penal Code or if he or she is the subject of a deportation order issued for behaviour linked to terrorist activities that have been found to be criminal offences, provided that removal remains a reasonable prospect and that no decision to place the foreign national under house arrest would allow sufficient control over him or her.If the judge orders that the detention period be extended, it will run for a further maximum period of thirty days, which may be renewed. The maximum period of detention shall then not exceed 180 days.

Article L742-6

Par dérogation à l’article L. 742-4, le juge des libertés et de la détention peut également être à nouveau saisi aux fins de prolongation du maintien en rétention au-delà de trente jours si l’étranger a été condamné à une peine d’interdiction du territoire pour des actes de terrorisme prévus par le titre II du livre IV du code pénal ou s’il fait l’objet d’une décision d’expulsion édictée pour un comportement lié à des activités à caractère terroriste pénalement constatées, dès lors que son éloignement demeure une perspective raisonnable et qu’aucune décision d’assignation à résidence ne permettrait un contrôle suffisant de cet étranger.
L’étranger peut être maintenu à disposition de la justice dans les conditions prévues à l’article L. 742-2.
Si le juge ordonne la prolongation de la rétention, celle-ci court pour une nouvelle période d’une durée maximale de trente jours qui peut être renouvelée. La durée maximale de la rétention n’excède alors pas cent quatre-vingts jours.
