Article L742-8 of the French Code governing the entry and residence of foreign nationals and the right of asylum

After the detention extension hearings provided for in this chapter, the foreign national may request that his detention be terminated by referring the matter to the liberty and detention judge. However, the decision to keep an asylum seeker in detention as provided for in article L. 754-3 may only be challenged before the administrative judge.
The decision shall be made in accordance with the procedure provided for in articles L. 743-3, L. 743-4, L. 743-6 to L. 743-12, L. 743-18 to L. 743-20, L. 743-24 and L. 743-25.

Hors des audiences de prolongation de la rétention prévues au présent chapitre, l’étranger peut demander qu’il soit mis fin à sa rétention en saisissant le juge des libertés et de la détention. La décision de maintien en rétention d’un demandeur d’asile prévue à l’article L. 754-3 ne peut toutefois être contestée que devant le juge administratif.
Il est statué suivant la procédure prévue aux articles L. 743-3, L. 743-4, L. 743-6 à L. 743-12, L. 743-18 à L. 743-20, L. 743-24 et L. 743-25.
