Article L743-12 of the French Code governing the entry and residence of foreign nationals and the right of asylum

In the event of a breach of the formalities prescribed by law on pain of nullity or failure to observe essential formalities, the liberty and custody judge to whom an application on this ground is made or who notes such an irregularity of his own motion may only order the release of the detainee or his continued detention where this has had the effect of infringing the rights of the foreign national.

Article L743-12

En cas de violation des formes prescrites par la loi à peine de nullité ou d’inobservation des formalités substantielles, le juge des libertés et de la détention saisi d’une demande sur ce motif ou qui relève d’office une telle irrégularité ne peut prononcer la mainlevée du placement ou du maintien en rétention que lorsque celle-ci a eu pour effet de porter atteinte aux droits de l’étranger.
