Article L743-9 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The liberty and detention judge, when the matter is referred to him or her for the purpose of extending the period of detention, shall remind the foreign national of his or her rights and shall ensure, on the basis of the entries in the register provided for in article L. 744-2 signed by the person concerned, that the latter has been fully informed of his or her rights as soon as possible following notification of the decision to place him or her in detention and has been placed in a position to assert them from the time of his or her arrival at the place of detention.
The judge shall take account of the particular circumstances relating in particular to the simultaneous detention of a large number of foreign nationals when assessing the time limits relating to notification of the decision, information about rights and their taking effect.

Le juge des libertés et de la détention, saisi aux fins de prolongation de la rétention, rappelle à l’étranger les droits qui lui sont reconnus et s’assure, d’après les mentions figurant au registre prévu à l’article L. 744-2 émargé par l’intéressé, que celui-ci a été, dans les meilleurs délais suivant la notification de la décision de placement en rétention, pleinement informé de ses droits et placé en état de les faire valoir à compter de son arrivée au lieu de rétention.
Le juge tient compte des circonstances particulières liées notamment au placement en rétention simultané d’un nombre important d’étrangers pour l’appréciation des délais relatifs à la notification de la décision, à l’information des droits et à leur prise d’effet.
