Article L763-3 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The actual removal of a foreign national who is the subject of a decision imposing an obligation to leave French territory may not take place in Saint-Martin:
1° If the consular authority so requests, before the expiry of a period of one clear day from notification of this decision;
2° If the foreign national has lodged an application with the administrative court on the basis of article L. 521-2 of the Code of Administrative Justice, before the interim relief judge has informed the parties whether or not a public hearing will be held pursuant to the second paragraph of article L. 522-1 of the same code, nor, if the parties have been informed of such a hearing, before the judge has ruled on the application.

Article L763-3

L’éloignement effectif de l’étranger faisant l’objet d’une décision portant obligation de quitter le territoire français ne peut intervenir à Saint-Martin :
1° Si l’autorité consulaire le demande, avant l’expiration du délai d’un jour franc à compter de la notification de cette décision ;
2° Si l’étranger a saisi le tribunal administratif d’une demande sur le fondement de l’article L. 521-2 du code de justice administrative, avant que le juge des référés ait informé les parties de la tenue ou non d’une audience publique en application du deuxième alinéa de l’article L. 522-1 du même code, ni, si les parties ont été informées d’une telle audience, avant que le juge ait statué sur la demande.
