The judicial police officer or, under his supervision, a member of the judicial police, will record in a report the reasons for the check, the verification of the person’s right to move or reside and the conditions under which the person was brought before him, informed of his rights and given the opportunity to exercise them. It specifies the day and time of the start and end of the detention and its duration and, where applicable, the taking of fingerprints or photographs as well as the visual inspection or search of luggage and personal effects and the dates and times of the start and end of these operations. This report is submitted for signature by the foreign national concerned, who is informed that he or she may refuse to sign it. If the foreign national refuses to sign the report, this refusal and the reasons for it are mentioned.
The report is forwarded to the public prosecutor and a copy is given to the person concerned. The details of each report concerning the identity of the person, the day and time of the start and end of the detention and its duration are also recorded in a special register kept for this purpose in the police or gendarmerie premises. This register may be kept in dematerialised form.
