Le manquement aux obligations de l’entreprise de transport est constaté par un procès-verbal établi par un agent relevant d’une catégorie fixée par décret en Conseil d’Etat.
L’entreprise de transport se voit remettre copie du procès-verbal et a accès au dossier. Elle est mise à même de présenter, dans un délai d’un mois, ses observations écrites sur le projet de sanction de l’autorité administrative.
