Article L8222-5 of the French Labour Code

The client or the person placing the order, informed in writing by an inspection officer mentioned in article L. 8271-7 or by a trade union or a professional association or an institution representing the personnel, of the intervention of the co-contractor, a sub-contractor or a sub-delegatee in an irregular situation with regard to the formalities mentioned in articles L. 8221-3 and L. 8221-5 , immediately enjoins his co-contractor to put an end to this situation without delay.

Failing this, he shall be jointly and severally liable with his co-contractor for the payment of the taxes, contributions, remuneration and charges mentioned in 1° to 3° of article L. 8222-2, under the conditions set out in article L. 8222-3.

The provisions of this article do not apply to individuals who contract for their own personal use, that of their spouse, partner in a civil solidarity pact, cohabitee, ascendants or descendants.

Article L8222-5

Le maître de l’ouvrage ou le donneur d’ordre, informé par écrit par un agent de contrôle mentionné à l’article L. 8271-7 ou par un syndicat ou une association professionnels ou une institution représentative du personnel, de l’intervention du cocontractant, d’un sous-traitant ou d’un subdélégataire en situation irrégulière au regard des formalités mentionnées aux articles L. 8221-3 et L. 8221-5 enjoint aussitôt à son cocontractant de faire cesser sans délai cette situation.

A défaut, il est tenu solidairement avec son cocontractant au paiement des impôts, taxes, cotisations, rémunérations et charges mentionnés aux 1° à 3° de l’article L. 8222-2, dans les conditions fixées à l’article L. 8222-3.

Les dispositions du présent article ne s’appliquent pas au particulier qui contracte pour son usage personnel, celui de son conjoint, partenaire lié par un pacte civil de solidarité, concubin, de ses ascendants ou descendants.
