Article L8232-1 of the French Labour Code

When a company manager concludes a contract for the performance of work or the supply of services with a contractor who recruits the necessary labour himself and the latter is not the owner of a business or a craft business, the company manager shall comply, with regard to the contractor’s employees employed in his establishment or the outbuildings thereof and subject to the same penalties as for his own employees, with the provisions laid down :

1° In article L. 1225-29, relating to compulsory prenatal and postnatal rest periods ;

2° Articles L. 1225-30 to L. 1225-33, relating to special provisions for breastfeeding;

3° Book I of Part Three, relating to working hours, rest periods and holidays;

4° Part Four, relating to health and safety at work.

Lorsqu’un chef d’entreprise conclut un contrat pour l’exécution d’un travail ou la fourniture de services avec un entrepreneur qui recrute lui-même la main-d’oeuvre nécessaire et que celui-ci n’est pas propriétaire d’un fonds de commerce ou d’un fonds artisanal, le chef d’entreprise respecte, à l’égard des salariés de l’entrepreneur employés dans son établissement ou les dépendances de celui-ci et sous les mêmes sanctions que pour ses propres salariés, les prescriptions prévues :

1° A l’article L. 1225-29, relatives aux repos obligatoires prénatal et postnatal ;

2° Aux articles L. 1225-30 à L. 1225-33, relatives aux dispositions particulières à l’allaitement ;

3° Au livre Ier de la troisième partie, relatives à la durée du travail, aux repos et aux congés ;

4° A la quatrième partie, relatives à la santé et à la sécurité au travail.
