Article LO4435-5 of the French General Code of Local Authorities

Appeals against this deliberation are referred to the Conseil d’Etat.

The representative of the State in the region may, within one month of receiving the transmission provided for in the first paragraph of article LO 4435-4, refer the deliberation to the Conseil d’Etat. This appeal suspends its implementation until the Conseil d’Etat has given its decision. If the Conseil d’Etat has not given its decision within three months of the matter being referred to it, the deliberation becomes enforceable once again.

Les recours dirigés contre cette délibération sont portés devant le Conseil d’Etat.

Le représentant de l’Etat dans la région peut, dans le mois qui suit sa réception de la transmission prévue au premier alinéa de l’article LO 4435-4, déférer la délibération au Conseil d’Etat. Ce recours en suspend l’exécution jusqu’à ce que le Conseil d’Etat ait rendu sa décision. Si celle-ci n’est pas intervenue dans un délai de trois mois suivant sa saisine, la délibération redevient exécutoire.
