Article LO6414-5 of the French General Code of Local Authorities

Under the conditions defined by the regulations enacted by the local authority, subject to the transfer of the resources required to exercise these powers, the communes may intervene in town planning matters.

The President of the Territorial Council may, by decree issued at the request or with the agreement of the municipal council, grant competence to the mayor, acting on behalf of the municipality, either for the investigation and issue of individual land use authorisations and planning certificates, or for the sole issue of such authorisations and certificates, under the conditions laid down by the regulations applicable to Saint-Pierre-et-Miquelon.

Dans les conditions définies par la réglementation édictée par la collectivité, sous réserve du transfert des moyens nécessaires à l’exercice de ces compétences, les communes peuvent intervenir en matière d’urbanisme.

Le président du conseil territorial peut donner, par arrêté pris sur la demande ou après accord du conseil municipal, compétence au maire, agissant au nom de la commune, soit pour l’instruction et la délivrance des autorisations individuelles d’occupation du sol et des certificats d’urbanisme, soit pour la seule délivrance de ces autorisations et certificats, dans les conditions prévues par la réglementation applicable à Saint-Pierre-et-Miquelon.
