Article LO6434-7 of the French General Code of Local Authorities

The local authority is obliged to grant its protection to the president of the territorial council, to the territorial councillor deputising for him or her or who has received a delegation, or to one of these elected representatives who has ceased to hold office when he or she is the subject of criminal proceedings in connection with acts that do not have the character of misconduct detachable from the performance of his or her duties.

La collectivité est tenue d’accorder sa protection au président du conseil territorial, au conseiller territorial le suppléant ou ayant reçu une délégation, ou à l’un de ces élus ayant cessé ses fonctions lorsque celui-ci fait l’objet de poursuites pénales à l’occasion de faits qui n’ont pas le caractère de faute détachable de l’exercice de ses fonctions.
