Article R1111-20-3 of the French Public Health Code

Where the beneficiary of the insurance has objected to the opening of a pharmaceutical record, the Conseil national de l’ordre des pharmaciens will keep, for a period of ten years from the date of notification that the objection has been taken into account, the data relating to the identity of the beneficiary, his contact details and, where applicable, those relating to his legal representative or the person responsible for the execution of a legal protection measure, as well as a record of the objection. The purpose of this storage, which is carried out under conditions that protect the confidentiality of the data, is to ensure that the right to object is exercised.

Lorsque le bénéficiaire de l’assurance s’est opposé à l’ouverture d’un dossier pharmaceutique, le Conseil national de l’ordre des pharmaciens conserve, pendant une durée de dix ans à compter de la notification de la prise en compte de l’opposition, les données relatives à l’identité du bénéficiaire, ses coordonnées, le cas échéant celles relatives à son représentant légal ou à la personne chargée de l’exécution d’une mesure de protection juridique ainsi que la trace de l’opposition. Cette conservation, qui est assurée dans des conditions préservant la confidentialité des données, a pour objet de garantir le respect de l’exercice du droit d’opposition.
