Article R1112-30 of the French Public Health Code

Sick or injured prisoners who cannot be transferred to an appropriate or specialised prison establishment due to their state of health or, if they are on remand, who cannot be removed from the courts before which they are due to appear, shall, with the authorisation of the Minister of Justice and at the behest of the Prefect admitted either to a specially equipped ward in the establishment, or to a room or premises where a certain degree of isolation is possible and where surveillance by the police or gendarmerie can be ensured without causing any inconvenience to hospital services or other patients.

In an emergency, the patient may be hospitalised before receiving ministerial authorisation.

Les détenus malades ou blessés qui ne peuvent être transférés dans un établissement pénitentiaire approprié ou spécialisé en raison de leur état de santé ou, s’ils sont prévenus, qui ne peuvent être éloignés des juridictions devant lesquelles ils ont à comparaître sont, sur autorisation du ministre de la justice et à la diligence du préfet, admis soit dans le service spécialement aménagé dans l’établissement, soit dans une chambre ou un local où un certain isolement est possible et où la surveillance par les services de police ou de gendarmerie peut être assurée sans entraîner de gêne pour l’exécution du service hospitalier ou pour les autres malades.

En cas d’urgence, il peut être procédé à l’hospitalisation avant réception de l’autorisation ministérielle.
