Article R1121-16 of the French Public Health Code

The national database mentioned in article L. 1121-16 is managed by the Minister for Health and is supplied by the investigators of the research mentioned in 1° of article L. 1121-1. Its implementation and procedures are determined under the conditions defined by Law no. 78-17 of 6 January 1978 relating to information technology, files and civil liberties.

When the Data Protection Committee requests, in accordance with the second paragraph of article L. 1121-16, that persons participating in research mentioned in 1° of article L. 1121-1 be included in the file, it shall determine a ban on these persons participating simultaneously in other research or a period of exclusion.

Article R1121-16

Le fichier national mentionné à l’article L. 1121-16 est géré par le ministre chargé de la santé et est alimenté par les investigateurs des recherches mentionnées au 1° de l’article L. 1121-1. Sa mise en œuvre et ses modalités sont déterminées dans les conditions définies par la loi n° 78-17 du 6 janvier 1978 relative à l’informatique, aux fichiers et aux libertés.

Lorsque le comité de protection des personnes demande, conformément au deuxième alinéa de l’article L. 1121-16, d’inscrire dans le fichier des personnes qui participent à une recherche mentionnée au 1° de l’article L. 1121-1, il détermine pour ces personnes une interdiction de participer simultanément à une autre recherche ou une période d’exclusion.
