Article R1123-24 of the French Public Health Code

The committee’s opinion includes :

1° The identification and title of the research ;

2° The name of the investigator or, where applicable, the coordinating investigator;

3° The name of the sponsor;

4° The dated identification of the documents on which the Committee has given its opinion, and in particular the protocol, the information document referred to in Article L. 1122-1 and, where applicable, the brochure for the investigator;

5° Where applicable, identification of any changes made during the appraisal of the application or after the start of the research;

6° The place where the research is being carried out, where this is subject to authorisation;

7° Where applicable, the date of the meeting during which the opinion was given and the names of the persons who deliberated on the project, the category to which they belong, their status as experts or specialists;

8° Its reasoning.

The Data Protection Committee will forward all opinions to the competent authority for information.

L’avis du comité comporte :

1° L’identification et l’intitulé de la recherche ;

2° Le nom de l’investigateur ou, le cas échéant, de l’investigateur coordonnateur ;

3° Le nom du promoteur ;

4° L’identification datée des documents sur lesquels le comité s’est prononcé, et notamment le protocole, le document d’information mentionné à l’article L. 1122-1 et, le cas échéant, la brochure pour l’investigateur ;

5° Le cas échéant, l’identification des modifications intervenues en cours d’instruction du dossier ou après le commencement de la recherche ;

6° Le lieu où se déroule la recherche, lorsqu’il est soumis à autorisation ;

7° Le cas échéant, la date de la séance durant laquelle l’avis a été rendu et le nom des personnes ayant délibéré sur le projet, la catégorie à laquelle ils appartiennent, leur qualité d’expert ou de spécialiste ;

8° Sa motivation.

Le comité de protection des personnes communique, pour information, tout avis à l’autorité compétente.
