In application of article L. 114-14, the Director transmits the Centre’s acts in accordance with the following provisions.
I.-The acts corresponding to the missions carried out by the centre on behalf of the State, the enforceability of which is, pursuant to I of article L. 114-14, subject to their transmission to the Minister responsible for sports, are the deliberations of the Board of Directors relating to :
a) The establishment’s project ;
b) The centre’s internal rules ;
c) The general conditions of recruitment, employment and remuneration of contract staff paid from the centre’s budget;
d) the creation of the establishment’s social administration committee and, where applicable, its specialised health, safety and working conditions committee;
II – Subject to the provisions of articles R. 114-17 and R. 114-18, the acts relating to the operation of the centre which, in order to become enforceable pursuant to II of article L. 114-14, must be forwarded to the representative of the State or, by delegation of the latter, to the rector of the academic region are :
1° Decisions of the Board of Directors relating to :
a) The conclusion of contracts, agreements and long leases ;
b) The rates for services and products provided for in 1° of III of article R. 114-20 ;
These decisions become enforceable fifteen days after they have been transmitted;
2° Decisions of the Director relating to :
a) Contracts, agreements and contracts with financial implications, with the exception of contracts awarded in accordance with an adapted procedure on account of their value in accordance with the provisions of article 28 of the Public Procurement Code;
b) Recourse to arbitration in the event of disputes arising from the performance of contracts entered into with foreign organisations by delegation of the Board of Directors.
These decisions become enforceable as soon as they are transmitted.
3° Decisions by the Director relating to the recruitment of contract staff paid from the Centre’s budget, with the exception of those taken to meet a need arising from a temporary or seasonal increase in activity.
These decisions become enforceable fifteen days after their transmission.
