Article R114-13 of the French Sports Code

In application of article L. 114-14, the Director transmits the Centre’s acts in accordance with the following provisions.

I.-The acts corresponding to the missions carried out by the centre on behalf of the State, the enforceability of which is, pursuant to I of article L. 114-14, subject to their transmission to the Minister responsible for sports, are the deliberations of the Board of Directors relating to :

a) The establishment’s project ;

b) The centre’s internal rules ;

c) The general conditions of recruitment, employment and remuneration of contract staff paid from the centre’s budget;

d) the creation of the establishment’s social administration committee and, where applicable, its specialised health, safety and working conditions committee;

II – Subject to the provisions of articles R. 114-17 and R. 114-18, the acts relating to the operation of the centre which, in order to become enforceable pursuant to II of article L. 114-14, must be forwarded to the representative of the State or, by delegation of the latter, to the rector of the academic region are :

1° Decisions of the Board of Directors relating to :

a) The conclusion of contracts, agreements and long leases ;

b) The rates for services and products provided for in 1° of III of article R. 114-20 ;

These decisions become enforceable fifteen days after they have been transmitted;

2° Decisions of the Director relating to :

a) Contracts, agreements and contracts with financial implications, with the exception of contracts awarded in accordance with an adapted procedure on account of their value in accordance with the provisions of article 28 of the Public Procurement Code;

b) Recourse to arbitration in the event of disputes arising from the performance of contracts entered into with foreign organisations by delegation of the Board of Directors.

These decisions become enforceable as soon as they are transmitted.

3° Decisions by the Director relating to the recruitment of contract staff paid from the Centre’s budget, with the exception of those taken to meet a need arising from a temporary or seasonal increase in activity.

These decisions become enforceable fifteen days after their transmission.

Article R114-13

En application de l’article L. 114-14, le directeur transmet les actes du centre conformément aux dispositions suivantes.

I.-Les actes correspondant aux missions exercées par le centre au nom de l’Etat dont le caractère exécutoire est, en application du I de l’article L. 114-14, subordonné à leur transmission au ministre chargé des sports sont les délibérations du conseil d’administration relatives :

a) Au projet d’établissement ;

b) Au règlement intérieur du centre ;

c) Aux conditions générales de recrutement, d’emploi et de rémunération des agents contractuels rémunérés sur le budget du centre ;

d) A la création du comité social d’administration d’établissement et, le cas échéant, de sa formation spécialisée en matière de santé, de sécurité et de conditions de travail ;

II.-Sous réserve des dispositions des articles R. 114-17 et R. 114-18, les actes relatifs au fonctionnement du centre qui, pour devenir exécutoires en application du II de l’article L. 114-14, doivent être transmis au représentant de l’Etat ou, par délégation de celui-ci, au recteur de région académique sont :

1° Les délibérations du conseil d’administration relatives :

a) A la passation des contrats, conventions et marchés, des baux emphytéotiques ;

b) Aux tarifs des services et aux produits prévus au 1° du III de l’article R. 114-20 ;

Ces délibérations deviennent exécutoires quinze jours après leur transmission ;

2° Les décisions du directeur relatives :

a) Aux contrats, conventions et marchés comportant des incidences financières, à l’exception des marchés passés selon une procédure adaptée en raison de leur montant conformément aux dispositions de l’article 28 du code des marchés publics ;

b) Au recours à l’arbitrage en cas de litiges nés de l’exécution de contrats passés avec des organismes étrangers par délégation du conseil d’administration.

Ces décisions deviennent exécutoires dès leur transmission.

3° Les décisions du directeur relatives au recrutement des agents contractuels rémunérés sur le budget du centre, à l’exception de celles prises pour faire face à un besoin lié à un accroissement temporaire ou saisonnier d’activité.

Ces décisions deviennent exécutoires quinze jours après leur transmission.
