In addition to its opinion and the expert report, the college will forward to the insurers and the persons it considers to be liable all the documents provided by the claimant to enable them to make an offer. Medical information is transmitted in compliance with medical confidentiality.
The offer referred to in the previous paragraph indicates the amount of compensation proposed for each of the heads of loss specified in the opinion of the college referred to in article R. 1142-63-13. The offer shall specify, where applicable, for each head of loss, the deviation from the opinion of the College with regard to the extent of the damage suffered. It also specifies, for each head of loss, the difference between the amount of compensation proposed and that which would result from the application of the compensation references relating to settlement offers approved by the Board of Directors of the Office national d’indemnisation des accidents médicaux in application of Article R. 1142-46.
The proposal made by the person considered to be liable indicates that, if the claimant considers the offer to be manifestly inadequate in the light of the opinion issued by the college and the heads of loss specified in this opinion, he may submit a request to the Office for the purpose of obtaining compensation from it, under the terms set out in article R. 1142-63-17. The proposal and the settlement agreement also state that the purpose of the compensation is to make good only the harm on which the college of experts has ruled and does not prejudge any worsening of the claimant’s state of health, which may, if necessary, be the subject of a new request for compensation.
