Article R1142-63 of the French Public Health Code

When the insurance cover of the person liable for the damage has been exhausted or has expired, the insurer shall immediately notify, by registered letter with acknowledgement of receipt, the victim or his beneficiaries, the person considered to be liable, the Office and, if the damage falls within its scope, the fund set up under article L. 426-1 of the Insurance Code.

The four-month period provided for in article L. 1142-14 runs from the date of receipt by the Office of the insurer’s letter.

Lorsque la couverture d’assurance de la personne responsable des dommages est épuisée ou expirée, l’assureur avertit sans délai, par lettre recommandée avec accusé de réception, la victime ou ses ayants droit, la personne considérée comme responsable, l’office et, si les dommages entrent dans son champ d’intervention, le fonds institué à l’article L. 426-1 du code des assurances.

Le délai de quatre mois prévu à l’article L. 1142-14 court à compter de la date de la réception par l’office de la lettre de l’assureur.
