I. – The declaration of a patient therapeutic education programme, referred to in article L. 1161-2, is sent, by any means which provides a date certain of its receipt, to the director general of the regional health agency within whose territorial jurisdiction the therapeutic education programme is to be implemented.
Where the programme falls within the territorial jurisdiction of several regional health agencies, the declaration file is sent by the programme coordinator to the director general of each regional health agency.
This file includes information relating to
1° The objectives of the programme and how it is organised ;
2° The number and qualifications of the coordinator and staff involved in the programme;
3° The population concerned by the programme;
4° The projected sources of funding.
5° Compliance with the obligations set out in articles L. 1161-1 to L. 1161-4 and R. 1161-3.
The composition of the declaration file is set by order of the Minister for Health.
II – The application is deemed to be complete if the Director General of the Regional Health Agency has issued an acknowledgement of receipt by any means giving a definite date of receipt or has not informed the applicant, by any means giving a definite date of receipt of this information, within two months of receipt of the application, of the list of missing or incomplete documents.
The declaration takes effect from the date on which the application is deemed to be complete.
III – Termination of the programme must be notified to the Director General of the Regional Health Agency, or to all the Directors General if the programme concerns several regions, within three months of it taking effect.
