Article R121-1 of the French Code of Criminal Procedure

It is allocated to personality investigators and judicial controllers, authorised natural persons:

1° For the verification of the material, family or social situation of persons who are the subject of an investigation carried out pursuant to the eighth paragraph of article 41 or the seventh paragraph of Article 81 : IP. 1. However, where the investigator has been unable to carry out his assignment due to the failure of the person concerned to respond to the summons, the allowance shall be IP. 6;

2° For the investigation into the personality of the persons under investigation as well as their material, family or social situation, carried out pursuant to the sixth paragraph of article 81 or for the investigation into the personality of the victim as well as the nature and extent of the prejudice suffered by the victim, provided for by l’article 81-1 : IP. 2;

3° For the judicial supervision mission carried out on each person under investigation, pursuant to 6° or 17° of l’article 138 :

-IP. 3 when the judicial supervision assignment lasts three months or less;

-IP. 4 when the mission of judicial supervision lasts more than three months but not more than one year;

-IP. 5 when the judicial supervision assignment lasts for more than one year.

4° For a mission to implement a probationary suspended sentence entrusted to them pursuant to the provisions of the last paragraph of Article 471 :

-IP. 3 when the assignment lasts three months or less;

-IP. 4 when it lasts more than three months but not more than one year;

-IP. 5 when it lasts more than one year.

Article R121-1

Il est alloué aux enquêteurs de personnalité et aux contrôleurs judiciaires, personnes physiques habilitées :

1° Pour la vérification de la situation matérielle, familiale ou sociale des personnes faisant l’objet d’une enquête accomplie en application du huitième alinéa de l’article 41 ou du septième alinéa de l’article 81 : IP. 1. Toutefois, lorsque l’enquêteur n’a pas pu remplir sa mission en raison de la carence de l’intéressé qui n’a pas répondu à la convocation, l’indemnité est de IP. 6 ;

2° Pour l’enquête sur la personnalité des personnes mises en examen ainsi que sur leur situation matérielle, familiale ou sociale, accomplie en application du sixième alinéa de l’article 81 ou pour l’enquête sur la personnalité de la victime ainsi que sur la nature et l’importance des préjudices subis par elle, prévue par l’article 81-1 : IP. 2 ;

3° Pour la mission de contrôle judiciaire exercée sur chaque personne mise en examen, en application des 6° ou 17° de l’article 138 :

-IP. 3 lorsque la mission de contrôle judiciaire dure trois mois ou moins ;

-IP. 4 lorsque la mission de contrôle judiciaire dure plus de trois mois sans excéder un an ;

-IP. 5 lorsque la mission de contrôle judiciaire dure plus d’un an.

4° Pour une mission de mise en oeuvre d’un sursis probatoire leur ayant été confiée en application des dispositions du dernier alinéa de l’article 471 :

-IP. 3 lorsque la mission dure trois mois ou moins ;

-IP. 4 lorsqu’elle dure plus de trois mois sans excéder un an ;

-IP. 5 lorsqu’elle dure plus d’un an.
