Article R121-36 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The Director General of the French Office for the Protection of Refugees and Stateless Persons prepares and implements the deliberations of the Board of Directors.
Within the framework of the guidelines defined by the Board, the Director General manages the Office, the departments of which are placed under his authority. In this capacity, he has the following powers in particular:
1° He/she is the authorising officer for revenue and expenditure;
2° He/she represents the Office in legal proceedings and in all civil acts;
3° He/she recruits, appoints and manages the Office’s permanent and temporary staff;
4° He/she chairs the technical committee and the health, safety and working conditions committee;
5° It concludes contracts and agreements binding the establishment and is responsible for contracts;
6° It may set up imprest accounts with the approval of the accounting officer under the conditions set out in article R. 121-38;
7° It reports on its management to the Board of Directors.
The General Manager is assisted by a General Secretary, a Deputy General Secretary and Heads of Division.
In the event that the General Manager is absent or unable to attend, the General Secretary deputises for him/her and acts as interim General Manager.

Le directeur général de l’Office français de protection des réfugiés et apatrides prépare et exécute les délibérations du conseil d’administration.
Dans le cadre des orientations définies par le conseil, le directeur général dirige l’office dont les services sont placés sous son autorité. A ce titre, il exerce notamment les compétences suivantes :
1° Il est l’ordonnateur des recettes et des dépenses ;
2° Il représente l’office en justice et dans tous les actes de la vie civile ;
3° Il recrute, nomme et gère les personnels titulaires et non titulaires de l’office ;
4° Il préside le comité technique et le comité d’hygiène, de sécurité et des conditions de travail ;
5° Il conclut les contrats et conventions engageant l’établissement et est responsable des marchés ;
6° Il peut créer des régies de recettes et d’avances sur avis conforme de l’agent comptable dans les conditions prévues à l’article R. 121-38 ;
7° Il rend compte de sa gestion au conseil d’administration.
Le directeur général est assisté d’un secrétaire général, d’un secrétaire général adjoint et de chefs de division.
En cas d’absence ou d’empêchement du directeur général, le secrétaire général le supplée et assure son intérim.
