I. – The commission in charge of the disability exception is placed under the Minister in charge of culture and the Minister in charge of the disabled.
It has the following missions:
1° To examine and issue an opinion on the applications submitted by the legal entities and establishments mentioned in the first paragraph of 7° of Article L. 122-5 with a view to registration on the list and the issue of authorisation under the conditions defined in Article R. 122-13;
2° To issue an opinion on the removal from the list and the withdrawal of authorisation provided for in Article R. 122-14;
3° To ensure that the exception provided for in the first paragraph of 7° of article L. 122-5 is implemented in compliance with the provisions of the same article and articles L. 122-5-1 and L. 122-5-2 and to warn the minister responsible for culture and the minister responsible for the disabled in the event of non-compliance with these conditions;
4° To make recommendations to the competent ministers concerning the implementation of the exception provided for in the first paragraph of 7° of article L. 122-5.
II. – The commission comprises ten members appointed by joint order of the minister responsible for culture and the minister responsible for people with disabilities for a period of five years:
1° Five members representing national organisations representing people with disabilities and their families;
2° Five members representing rights holders.
A representative of the Bibliothèque nationale de France participates in the work of the commission in an advisory capacity.
III. – The chairman of the commission is elected by the members for a period of one year, alternately from among the representatives of organisations representing people with disabilities and from among the representatives of rights holders.
The members of the commission perform their duties free of charge. However, they may be reimbursed for their travel and subsistence expenses under the conditions laid down in the regulations applicable to civil servants of the State.
IV. – The commission adopts its own rules of procedure.
The commission’s secretariat is provided jointly by the ministries responsible for culture and disabled people.
