Article R1221-3 of the French Labour Code

The pre-recruitment declaration is sent by the employer :

1° Either to the body responsible for collecting contributions under the general social security scheme in whose territorial jurisdiction the establishment that is to employ the employee is located and to the occupational health service mentioned in 1° of article R. 1221-1 ;

2° Or, in the case of an employee covered by the agricultural social protection scheme, to the caisse de mutualité sociale agricole in the employee’s place of work.

3° Or, in the case of an employee covered by the special scheme for seamen, to the union for the collection of social security and family allowance contributions mentioned in article L. 213-4 of the Social Security Code.

Article R1221-3

La déclaration préalable à l’embauche est adressée par l’employeur :

1° Soit à l’organisme de recouvrement des cotisations du régime général de sécurité sociale dans le ressort territorial duquel est situé l’établissement devant employer le salarié et au service de santé au travail mentionné au 1° de l’article R. 1221-1 ;

2° Soit, s’il s’agit d’un salarié relevant du régime de la protection sociale agricole, à la caisse de mutualité sociale agricole du lieu de travail de ce salarié.

3° Soit, s’il s’agit d’un salarié relevant du régime spécial des marins, à l’union pour le recouvrement des cotisations de sécurité sociale et d’allocations familiales mentionnée à l’ article L. 213-4 du code de la sécurité sociale .
