Article R1227-2 of the French Labour Code

The following is punishable by a fourth-class fine:

1° Contravening the provisions of article R. 1221-9 relating to the provision of a copy of the pre-employment declaration or the acknowledgement of receipt to the employee or, failing this, failing to provide the employee with a written contract accompanied by an indication of the body to which the pre-employment declaration is addressed;

2° Failing to produce, at the request of any of the inspection officers referred to in article L. 8271-7 , the acknowledgement of receipt provided for in article R. 1221-7 if it is still required to be kept pursuant to article R. 1221-8 or, until such time as it has received this acknowledgement, failing to provide them with information enabling them to verify that it has made the declaration prior to hiring the employee, in breach of the provisions of article R. 1221-12.

Article R1227-2

Est puni de l’amende prévue pour les contraventions de la quatrième classe le fait :

1° De contrevenir aux dispositions de l’article R. 1221-9 relatives à la remise d’une copie de la déclaration préalable à l’embauche ou de l’accusé de réception au salarié ou, à défaut, de ne pas délivrer au salarié de contrat écrit accompagné de la mention de l’organisme destinataire de la déclaration préalable d’embauche ;

2° De ne pas présenter à toute réquisition des agents de contrôle mentionnés à l’article L. 8271-7 l’avis de réception prévu par l’article R. 1221-7 s’il est encore tenu de le conserver en application de l’article R. 1221-8 ou, tant qu’il n’a pas reçu cet avis, de ne pas leur communiquer les éléments leur permettant de vérifier qu’il a procédé à la déclaration préalable à l’embauche du salarié, en méconnaissance des dispositions de l’article R. 1221-12.
