Article R123-315 of the French Commercial code

The keeper of the National Register of Companies, informed by any administrative or judicial authority through the intermediary of the single body mentioned in article R. 123-1 and under the conditions provided for in article R. 123-7, shall proceed with the deletion of any natural person:

1° In the event of the death of the registered person more than one year previously, unless the beneficiaries or heirs exercise the right to maintain the registration provided for in article R. 123-248;

2° In the event of disqualification from practising any self-employed activity by virtue of a final court decision or an enforceable administrative decision.
When informed of the striking off of the register by a social security body pursuant to article L. 613-4 of the Social Security Code, the keeper of the National Register of Companies will remove the sole proprietorship concerned from the National Register of Companies.

Article R123-315

Le teneur du Registre national des entreprises, informé par toute autorité administrative ou judiciaire par l’intermédiaire de l’organisme unique mentionné à l’article R. 123-1 et dans les conditions prévues à l’article R. 123-7, procède à la radiation de toute personne physique :

1° En cas de décès de la personne immatriculée survenu depuis plus d’un an, sauf exercice par les ayant droits ou les héritiers du maintien de l’immatriculation prévu par l’article R. 123-248 ;

2° En cas d’interdiction d’exercice de toute activité indépendante en vertu d’une décision judiciaire passée en force de chose jugée ou d’une décision administrative exécutoire.

Lorsqu’il est informé de la radiation prononcée par un organisme de sécurité sociale en application de l’article L. 613-4 du code de la sécurité sociale, le teneur du Registre national des entreprises procède à la radiation du Registre national des entreprises de l’entreprise individuelle concernée.
