Article R123-316 of the French Commercial code

The keeper of the National Register of Companies shall proceed with the striking off of any person:

1° As from the closure of bankruptcy proceedings, the liquidation of assets due to insufficient assets or the dissolution of the association, or the judicial liquidation due to insufficient assets;

3° At the end of the period of one month following the mention of the request for regularisation in application of article R. 123-308, where the natural person has not regularised his situation.

Article R123-316

Le teneur du Registre national des entreprises procède à la radiation de toute personne :

1° A compter de la clôture d’une procédure, soit de faillite, soit de liquidation des biens pour insuffisance d’actif ou dissolution de l’union, soit de liquidation judiciaire pour insuffisance d’actif ;

2° Au terme du délai d’un an après la mention au registre de la cessation totale de son activité, sauf en ce qui concerne les personnes morales pouvant faire l’objet d’une dissolution ;

3° Au terme du délai d’un mois après la mention de demande de régularisation en application de l’article R. 123-308, lorsque la personne physique n’a pas régularisé sa situation.
