Article R1232-15 of the French Public Health Code

Any establishment or organisation planning to carry out research requiring the use of an organ removed from a person whose death has been duly confirmed must send the Director General of the Agence de la biomédecine, by registered post with acknowledgement of receipt, a protocol including in particular a description of the research programme and the nature and number of samples envisaged. This protocol is included in a file, the form and content of which are laid down by order of the Minister for Research after obtaining the opinion of the Director General of the Agence de la biomédecine.

The file includes, in particular, the purpose, title and duration of the research protocols, the identification of the declarant and the participants in the protocol as well as their titles and status, the nature of the samples envisaged, and the information required to ensure compliance with the legal and regulatory conditions for the samples.

Tout établissement ou organisme qui envisage de procéder à une recherche nécessitant le recours à un organe prélevé sur une personne dont la mort a été dûment constatée adresse au directeur général de l’Agence de la biomédecine, sous pli recommandé avec demande d’avis de réception, un protocole comprenant notamment une description du programme de recherche ainsi que la nature et le nombre des prélèvements envisagés. Ce protocole est inclus dans un dossier dont la forme et le contenu sont fixés par arrêté du ministre chargé de la recherche après avis du directeur général de l’Agence de la biomédecine.

Le dossier comprend notamment l’objet, le titre et la durée des protocoles de recherche, l’identification du déclarant et des participants au protocole ainsi que leurs titres et qualité, la nature des prélèvements envisagés, les éléments permettant de s’assurer du respect des conditions légales et réglementaires des prélèvements.
