Article R1234-9 of the French Labour Code

At the time of expiry or termination of the employment contract, the employer will issue the employee with the certificates and evidence enabling him/her to exercise his/her rights to the benefits mentioned in article L. 5421-2 and will forward these same certificates to Pôle emploi without delay.

Employers with at least eleven employees send this information to Pôle emploi electronically, unless they are unable to do so for reasons beyond their control, in accordance with the procedures specified in an order issued by the Minister for Employment. (1)

L’employeur délivre au salarié, au moment de l’expiration ou de la rupture du contrat de travail, les attestations et justifications qui lui permettent d’exercer ses droits aux prestations mentionnées à l’article L. 5421-2 et transmet sans délai ces mêmes attestations à Pôle emploi.

Les employeurs d’au moins onze salariés effectuent cette transmission à Pôle emploi par voie électronique, sauf impossibilité pour une cause qui leur est étrangère, selon des modalités précisées par un arrêté du ministre chargé de l’emploi. (1)
