Article R1235-4 of the French Labour Code

The debtor may lodge an objection within fifteen days of notification of the constraint with the clerk of the court in whose jurisdiction the debtor’s registered office is located, if the debtor is a legal entity, or with the debtor himself, if the debtor is a natural person:

1° By declaration;

2° By any means that provides a date certain for receipt of the objection.

The objection must state the reasons on which it is based. A copy of the contested constraint is attached.

This objection suspends the enforcement of the constraint.

Le débiteur peut former opposition dans les quinze jours à compter de la notification de la contrainte auprès du greffe de la juridiction dans le ressort de laquelle est domicilié son siège social, s’il s’agit d’une personne morale, ou lui-même, s’il s’agit d’une personne physique :


1° Par déclaration ;


2° Par tout moyen donnant date certaine à la réception de cette opposition.


L’opposition est motivée. Une copie de la contrainte contestée y est jointe.


Cette opposition suspend la mise en œuvre de la contrainte.
