Article R124-4 of the French Code of civil enforcement procedures

The person responsible for amicable debt collection shall send the debtor a letter containing the following information:

1° The name or corporate name of the person in charge of amicable debt collection, his address or registered office, and an indication that he carries out amicable debt collection activities;

2° The name or corporate name of the creditor, his address or registered office;

3° The basis and amount of the principal, interest and other ancillary sums owed, distinguishing between the various components of the debt, with the exception of the costs that remain payable by the creditor pursuant to the third paragraph of article L. 111-8;

4° An indication that you are required to pay the sum due and the terms and conditions for payment of the debt;

5° Reproduction of the second and third paragraphs of Article L. 111-8.

The references and date of dispatch of the letter referred to in the first paragraph are recalled when any other approach is made to the debtor with a view to amicable collection.

La personne chargée du recouvrement amiable adresse au débiteur une lettre qui contient les mentions suivantes :

1° Les nom ou dénomination sociale de la personne chargée du recouvrement amiable, son adresse ou son siège social, l’indication qu’elle exerce une activité de recouvrement amiable ;

2° Les nom ou dénomination sociale du créancier, son adresse ou son siège social ;

3° Le fondement et le montant de la somme due en principal, intérêts et autres accessoires, en distinguant les différents éléments de la dette, à l’exclusion des frais qui restent à la charge du créancier en application du troisième alinéa de l’article L. 111-8 ;

4° L’indication d’avoir à payer la somme due et les modalités de paiement de la dette ;

5° La reproduction des deuxième et troisième alinéas de l’article L. 111-8.

Les références et date d’envoi de la lettre mentionnée au premier alinéa sont rappelées à l’occasion de toute autre démarche auprès du débiteur en vue du recouvrement amiable.
