Article R1243-57 of the French Public Health Code

Any organisation which ensures the conservation and preparation of tissues or cells from the human body and their derivatives, with a view to their transfer for scientific use, including for the purposes of genetic research, holds an authorisation issued by the Minister responsible for research and, where applicable, by the Director General of the regional health agency. For the purposes of this sub-section, the term “transfer” covers transfers made free of charge or for consideration.

The provisions of this sub-section also apply to the activities defined in the first paragraph relating to elements retained at the end of research involving the human person as defined in Article L. 1121-1.

Tout organisme qui assure la conservation et la préparation des tissus ou des cellules issus du corps humain et leurs dérivés, en vue de leur cession pour un usage scientifique, y compris à des fins de recherche génétique, est titulaire d’une autorisation délivrée par le ministre chargé de la recherche et, le cas échéant, par le directeur général de l’agence régionale de santé. Au sens de la présente sous-section, le terme de cession recouvre les cessions consenties à titre gratuit ou onéreux.


Sont également soumises aux dispositions de la présente sous-section les activités définies au premier alinéa portant sur des éléments conservés à l’issue d’une recherche impliquant la personne humaine telle que définie à l’article L. 1121-1.
