Article R1253-43 of the French Labour Code

Where the private-sector members of an employers’ grouping that includes local and regional authorities fall within the scope of the same collective agreement, that agreement shall apply to the grouping set up pursuant to article L. 1253-19.
Otherwise, all members choose the collective agreement they wish the grouping to apply, subject to the provisions of article D. 1253-7.

Lorsque les adhérents de droit privé du groupement d’employeurs comprenant des collectivités territoriales entrent dans le champ de la même convention collective, celle-ci s’applique au groupement constitué en application de l’article L. 1253-19.
Dans le cas contraire, tous les adhérents choisissent la convention collective qu’ils souhaitent voir appliquée par le groupement, sous réserve des dispositions de l’article D. 1253-7.
