Article R1261-2 of the French Public Health Code

When the death is declared, the copy of the declaration referred to in III of article R. 1261-1 kept by the donor and, where applicable, his donor card, shall be given to the civil registrar.

The funeral director, chosen by the establishment authorised in accordance with the second paragraph of article L. 1261-1, shall assist the family, close relatives and, where applicable, the reference person referred to in article R. 1261-1, until the body is removed. 1261-1, assists the family, the next of kin and, where applicable, the reference person mentioned in article R. 1261-1, until the body is removed.

They are given a copy of the information document provided for in II of article R. 1261-1.

After death, the transport is declared in advance, by any written means, to the mayor of the municipality of the place of death or of deposit. The declaration is subject to possession of an extract from the death certificate provided for in article L. 2223-42 of the General Local Authorities Code certifying that the death does not pose any medico-legal problems and that the donor was not suffering from one of the transmissible infections on one of the lists mentioned in article R. 2213-2-1 of the same code.

Article R1261-2

Lors de la déclaration de décès, l’exemplaire de la déclaration mentionnée au III de l’article R. 1261-1 conservé par le donneur, et, le cas échéant, sa carte de donneur, sont remis à l’officier d’état civil.

L’opérateur de pompes funèbres, choisi par l’établissement autorisé conformément au deuxième alinéa de l’article L. 1261-1, assiste la famille, les proches ainsi que, le cas échéant, la personne référente mentionnée à l’article R. 1261-1, jusqu’à l’enlèvement du corps.

Un exemplaire du document d’information prévu au II de l’article R. 1261-1 leur est remis.

Après le décès, le transport est déclaré préalablement, par tout moyen écrit, auprès du maire de la commune du lieu de décès ou de dépôt. La déclaration est subordonnée à la détention d’un extrait du certificat de décès prévu à l’article L. 2223-42 du code général des collectivités territoriales attestant que le décès ne pose pas de problème médico-légal et que le donneur n’était pas atteint de l’une des infections transmissibles figurant sur l’une des listes mentionnées à l’article R. 2213-2-1 du même code.
