Article R1261-23 of the French Public Health Code

For any training or research project involving an entity other than the authorised establishment which houses a body reception facility, the head of the body reception facility shall send the head of this entity a draft agreement.

This draft agreement shall be sent to the body reception facility’s ethics, scientific and educational committee for its opinion by the head of the body reception facility together with the application for authorisation of the training or research project in accordance with article R. 1261-16.

The agreement organises the relationship between this entity and the institution. In the situations provided for in the last paragraph of article R. 1261-11, it lays down the terms and conditions for access to the body reception facility by persons from outside the authorised establishment, the procedures for transporting the body and its preservation when a temporary removal is made necessary. The agreement determines, subject to the second paragraph of article R. 1261-12, the responsibilities incumbent on successive participants and the related financial conditions.

Pour tout projet de formation ou de recherche qui concerne une entité distincte de l’établissement autorisé qui héberge une structure d’accueil des corps, le responsable de la structure d’accueil des corps adresse au responsable de cette entité un projet de convention.

Ce projet est transmis pour avis au comité d’éthique, scientifique et pédagogique de la structure d’accueil des corps par son responsable avec la demande d’autorisation du projet de formation ou de recherche conformément à l’article R. 1261-16.

La convention organise les relations de cette entité avec l’établissement. Elle prévoit, dans les situations prévues par le dernier alinéa de l’article R. 1261-11, les modalités d’accès des personnes extérieures à l’établissement autorisé à la structure d’accueil des corps, les procédures de transport du corps et de sa conservation lorsqu’une sortie temporaire est rendue nécessaire. La convention détermine, sous réserve du deuxième alinéa de l’article R. 1261-12, les responsabilités qui incombent aux intervenants successifs ainsi que les conditions financières afférentes.
