Article R1263-12-1 of the French Labour Code

For the application of II of article L. 1262-4-1, the project owner shall ask the subcontractor established outside France, before the start of each posting of one or more employees on national territory, for the acknowledgement of receipt of the posting declaration sent to the departmental unit mentioned in article R. 1263-4-1, in accordance with the provisions of article R. 1263-6-1.

Before the start of each posting of one or more employees on national territory, the project owner shall request from the temporary employment business established outside France with which its co-contractor or a sub-contractor has a contract, the acknowledgement of receipt of the posting declaration sent to the departmental unit mentioned in article R. 1263-4-1, in accordance with the provisions of article R. 1263-6-1.

The project owner is deemed to have carried out the verification referred to in II of article L. 1262-4-1 once he has received these documents.

Article R1263-12-1

Pour l’application du II de l’article L. 1262-4-1, le maître d’ouvrage demande au sous-traitant établi hors de France, avant le début de chaque détachement d’un ou de plusieurs salariés sur le territoire national, l’accusé de réception de la déclaration de détachement transmis à l’unité départementale mentionnée à l’article R. 1263-4-1, conformément aux dispositions de l’article R. 1263-6-1.

Le maître d’ouvrage demande à l’entreprise exerçant une activité de travail temporaire établie hors de France avec laquelle son cocontractant ou un sous-traitant a contracté, et avant le début de chaque détachement d’un ou de plusieurs salariés sur le territoire national, l’accusé de réception de la déclaration de détachement transmis à l’unité départementale mentionnée à l’article R. 1263-4-1, conformément aux dispositions de l’article R. 1263-6-1.

Le maître d’ouvrage est réputé avoir procédé à la vérification mentionnée au II de l’article L. 1262-4-1 dès lors qu’il s’est fait remettre ces documents.
