Article R1263-17 of the French Labour Code

If the employer does not effectively regularise the situation, the project owner or the principal, if he does not terminate the service provision contract, is jointly and severally liable with the employer for payment of the remuneration and allowances due to each seconded employee and, where the employee is covered by a French social security scheme, the relevant social security contributions due to the bodies responsible for collecting them.

En cas d’absence de régularisation effective de la situation par l’employeur, le maître d’ouvrage ou le donneur d’ordre, s’il ne dénonce pas le contrat de prestation de service, est tenu solidairement avec celui-ci au paiement des rémunérations et indemnités dues à chaque salarié détaché ainsi que, lorsque ce salarié relève d’un régime français de sécurité sociale, des cotisations et contributions sociales afférentes dues aux organismes chargés de leur recouvrement.
