A drawee who has refused to pay all or part of a cheque for lack of sufficient funds shall send the account holder the injunction provided for in article L. 131-73 by registered letter with acknowledgement of receipt.
It specifies the number and amount of the cheque for which payment could not be guaranteed, as well as the status of the account on the date payment was refused.
It enjoins him to return to all the bankers of which he is a customer the cheque forms in his possession or that of his agents. It prohibits him from issuing cheques in the future, except for cash withdrawal or certified cheques, until the situation has been rectified in accordance with the conditions set out in articles R. 131-20 to R. 131-22 or, failing this, for five years from the date of the injunction.
It shall inform by any means any authorised representative that the holder, at his request, has informed it as being in possession of cheques that can be used on the account that it is no longer possible, until the situation is regularised, to issue cheques on this account.
If the same cheque is not paid for when presented again, the drawee does not send an injunction letter.
