Article R131-26 of the French Monetary and Financial Code

The notice of non-payment for insufficient funds drawn up pursuant to article L. 131-84 must include all the information provided for in 1°, 2°, 4°, 5°, 6° and 8° of article R. 131-12, as well as the registration number of the incident with the drawee.

This notice is sent to the Banque de France no later than the second business day following the refusal to pay the cheque. Where the account holder has issued the cheque in breach of a ban that is still in force, this period expires no later than the fifth business day following the refusal of payment.

L’avis de non-paiement pour défaut de provision suffisante établi en application de l’article L. 131-84 doit comporter tous les renseignements prévus aux 1°, 2°, 4°, 5°,6° et 8° de l’article R. 131-12, ainsi que le numéro d’enregistrement de l’incident chez le tiré.

Cet avis est transmis à la Banque de France au plus tard le deuxième jour ouvré suivant le refus de paiement du chèque. Lorsque le titulaire du compte a émis le chèque au mépris d’une interdiction toujours en vigueur, ce délai expire au plus tard le cinquième jour ouvré suivant le refus de paiement.
