Referrals made by associations authorised under the second paragraph of article L. 1313-3 must be sent by the head of the association, or by his or her representative expressly designated by proxy, to the Director General of the Agency. It must be duly substantiated and, where appropriate, accompanied by any supporting documents. In the event of a joint referral by several bodies, a single referral may be sent, countersigned by the various petitioners.
A copy of the referral is sent by the Agency’s Director General to the relevant supervisory ministries.
The Director General acknowledges receipt of the referral and sends a copy to the relevant supervisory ministries. He decides, in accordance with the procedure adopted by the Board of Directors, what action to take, taking into account the Agency’s resources and priorities. It reports to the Board of Directors and informs the applicant, specifying, where appropriate, the time required for its examination.
The opinion issued by the Agency is sent to the applicant by registered post with acknowledgement of receipt. It is sent to the ministers responsible for the Agency and to the other ministers concerned.
