Article R132-10 of the French Intellectual Property Code

The request for registration of the pledge is made by filing a slip, the form of which is determined by decision of the Director General of the National Institute of Industrial Property.

The slip shall include the following particulars:

1° The surname, forenames, domicile or company name, legal form and registered office of the creditor and debtor;

2° The designation of the software by its name, its trademark with a precise indication of all identification elements and characteristics such as the designation of the source code, operating documents and updates as well as, where applicable, the references of a deposit of the software ;

3° The nature and date of the deed constituting the pledge;

4° The amount of the claim expressed in the deed, its due date, the conditions relating to interest as well as ancillary costs.

Attached to this slip are:

– one of the originals of the deed constituting the pledge;

– a reproduction of the aforementioned deed where the claimant intends the original or copy to be returned to him;

– proof of payment of the prescribed fee;

– where applicable, the power of attorney.

La demande d’inscription du nantissement est réalisée par le dépôt d’un bordereau dont la forme est déterminée par décision du directeur général de l’Institut national de la propriété industrielle.

Le bordereau comprend les indications suivantes :

1° Les nom, prénoms, domicile ou la dénomination sociale, forme juridique et siège social du créancier et du débiteur ;

2° La désignation du logiciel par son nom, sa marque avec l’indication précise de tous éléments d’identification et caractéristiques tels que la désignation du code-source, des documents de fonctionnement et des mises à jour ainsi que, le cas échéant, les références d’un dépôt du logiciel ;

3° La nature et la date de l’acte constitutif du nantissement ;

4° Le montant de la créance exprimée dans l’acte, son exigibilité, les conditions relatives aux intérêts ainsi que les frais accessoires.

A ce bordereau sont joints :

– un des originaux de l’acte constitutif du nantissement ;

– une reproduction de l’acte susmentionné lorsque le demandeur entend que l’original ou l’expédition lui soit restitué ;

– la justification du paiement de la redevance prescrite ;

– s’il y a lieu, le pouvoir du mandataire.
