Article R132-11 of the French Intellectual Property Code

Deeds having the effect of modifying or annulling the published rights of the debtor and the creditor, such as, in particular, the assignment, the granting of a right of exploitation, the assignment of the pledge or the renunciation thereof, as well as legal claims and final judicial decisions relating to these rights, shall be registered at the request of one of the parties to the deed.

The application shall include:

1° A registration application form, the form of which shall be determined by decision of the Director General of the National Institute of Industrial Property;

2° One of the originals of the private deed or, as the case may be, a copy of the authentic instrument or of the deed initiating proceedings ;

3° A reproduction of the aforementioned deed where the applicant intends the original or the copy to be returned to him;

4° Proof of payment of the prescribed fee;

5° Where applicable, the proxy’s power of attorney.

Article R132-11

Les actes ayant pour effet de modifier ou d’anéantir les droits publiés du débiteur et du créancier, tels que, notamment, la cession, la concession d’un droit d’exploitation, la cession du nantissement ou la renonciation à ce dernier, ainsi que les demandes en justice et les décisions judiciaires définitives relatives à ces droits, sont inscrits à la demande de l’une des parties à l’acte.

La demande comprend :

1° Un bordereau de demande d’inscription dont la forme est déterminée par décision du directeur général de l’Institut national de la propriété industrielle ;

2° Un des originaux de l’acte sous seing privé ou, selon les cas, une expédition de l’acte authentique ou de l’acte introductif d’instance ;

3° Une reproduction de l’acte susmentionné lorsque le demandeur entend que l’original ou l’expédition lui soit restitué ;

4° La justification du paiement de la redevance prescrite ;

5° S’il y a lieu, le pouvoir du mandataire.
