Article R1321-27 of the French Public Health Code

Without prejudice to the provisions of article R. 1321-47, when the quality limits are not complied with and whether or not this non-compliance is attributable to the private distribution system, the person responsible for producing or distributing the water must take the necessary corrective measures as quickly as possible in order to restore the quality of the water.

The person responsible must inform the mayor and the director general of the regional health agency, who will forward this information to the prefect responsible for the area, of the effective application of the measures taken. It gives priority to the application of these measures, taking into account, among other things, the extent to which the quality limit has been exceeded and the potential danger to human health.

For packaged water, the provisions applicable are those of article R. 1322-44-7.

Sans préjudice des dispositions prévues à l’article R. 1321-47, lorsque les limites de qualité ne sont pas respectées et que ce non-respect soit ou non imputable à l’installation privée de distribution, la personne responsable de la production ou de la distribution d’eau doit prendre le plus rapidement possible les mesures correctives nécessaires afin de rétablir la qualité de l’eau.

Elle informe de l’application effective des mesures prises le maire et le directeur général de l’agence régionale de santé, qui transmet cette information au préfet territorialement compétent. Elle accorde la priorité à l’application de ces mesures, compte tenu, entre autres, de la mesure dans laquelle la limite de qualité a été dépassée et du danger potentiel pour la santé des personnes.
