Article R1321-88 of the French Public Health Code

The labelling of packaged spring waters that are held with a view to sale, offered for sale, sold or distributed free of charge must include, in addition to the particulars provided for in Article 9 of Regulation (EU) No 1169/2011 of the European Parliament and of the Council of 25 October 2011, as amended, on the provision of food information to consumers, the following particulars:

1° The name of the source exploited by one or more natural or drilled outlets ;

2° An indication of the place of exploitation and, in the cases provided for in Article 26 of Regulation (EU) No 1169/2011 of the European Parliament and of the Council of 25 October 2011, as amended, on the provision of food information to consumers, an indication of the country of origin ;

3° An indication that the product has been treated with ozone-enriched air;

4° An indication relating to other treatments designed to separate certain undesirable constituents, with the exception of filtration or decantation.

An order from the ministers responsible for consumer affairs and health sets out, where necessary, the procedures for applying the provisions mentioned in 3° and 4° of this article.

L’étiquetage des eaux de source conditionnées qui sont détenues en vue de la vente, mises en vente, vendues ou distribuées à titre gratuit doit comporter, outre les mentions prévues à l’article 9 du règlement (UE) n° 1169/2011 du Parlement européen et du Conseil du 25 octobre 2011 modifié concernant l’information des consommateurs sur les denrées alimentaires, les mentions suivantes :

1° Le nom de la source exploitée par une ou plusieurs émergences naturelles ou forées ;

2° L’indication du lieu d’exploitation et, dans les cas prévus par les dispositions de l’article 26 du règlement (UE) n° 1169/2011 du Parlement européen et du Conseil du 25 octobre 2011 modifié concernant l’information des consommateurs sur les denrées alimentaires, la mention du pays d’origine ;

3° L’indication se rapportant au traitement à l’aide d’air enrichi en ozone ;

4° L’indication se rapportant aux autres traitements ayant pour objet la séparation de certains constituants indésirables, à l’exception de l’opération de filtration ou de décantation.

Un arrêté des ministres chargés de la consommation et de la santé fixe, en tant que de besoin, les modalités d’application des dispositions mentionnées aux 3° et au 4° du présent article.
