Article R1322-12 of the French Public Health Code

The holder of an operating licence must declare to the Prefect any project to modify the installations and operating conditions mentioned in the prefectoral authorisation order and send him all the information needed to assess the project, prior to its implementation.

The Prefect decides on this declaration within two months, either by issuing an amending order, or, in application of II of article L. 1322-1, by inviting the holder of the authorisation, where appropriate after consultation with a public health hydrogeologist under the conditions laid down in article R. 1321-14, to request a revision of the initial authorisation. If no decision is taken within this period, the proposed amendment is deemed to have been accepted.

A hydrogeologist must be consulted when the changes requested concern the operating flow rate.

In the event of modification of the installations and operating conditions, a new verification, carried out under the conditions provided for in article R. 1322-9, is carried out before the installations are put back into service.

Le titulaire d’une autorisation d’exploiter déclare au préfet tout projet de modification des installations et des conditions d’exploitation mentionnées dans l’arrêté préfectoral d’autorisation et lui transmet tous les éléments utiles pour l’appréciation du projet, préalablement à son exécution.

Le préfet statue sur cette déclaration dans un délai de deux mois, ou bien en prenant un arrêté modificatif, ou bien, en application du II de l’article L. 1322-1, en invitant le titulaire de l’autorisation, le cas échéant après consultation d’un hydrogéologue agréé en matière d’hygiène publique dans les conditions prévues à l’article R. 1321-14, à solliciter une révision de l’autorisation initiale. A défaut de décision dans ce délai, le projet de modification est réputé accepté.

La consultation d’un hydrogéologue est obligatoire lorsque les modifications demandées concernent le débit d’exploitation.

En cas de modification des installations et des conditions d’exploitation, une nouvelle vérification, effectuée dans les conditions prévues à l’article R. 1322-9, est réalisée avant la remise en service de ces installations.
